The United States Supreme Courts decision in Rush v. Savchuk, 444 U.S. 320 (1980), applies retroactively to cases pending in Minnesota courts as of the date Rush wad decided. Therefore, as in the instant case, where jurisdiction is established solely via the discredited attachment-of-insurance-policy method of quasi-in-rem jurisdiction, the court must dismiss the case under the teachings of Rush for lack of jurisdiction.
